We reserve the right, at our discretion, to change, modify, and/or remove any of these terms and conditions at any time. Any use by you of the website or the services after such change shall be deemed to be your acceptance of those changes.

Acceptance of your order

We must receive payment of the price of the products and the delivery charges before we can accept your order. We reserve the right to restrict the number of products you may order and to refuse any order. If you have provided us with your email address you will receive an email from us confirming that we have received your order. This email is sent automatically and does not mean that we have accepted your order. Our acceptance of your order takes place upon delivery of the products. Only when we have accepted your order is a binding contract created between us.

Prices

Our prices are set out on our website in Pounds Sterling and are inclusive of United Kingdom-rated VAT where applicable. You are responsible for the disclosure and payment of any import duties or other taxes which apply in the country to which the products are delivered. Prices remain in force until we publish new prices on our website. Delivery charges may apply and are displayed during the order process.

All orders will be charged in Pounds Sterling as shown on your order confirmation. If you are purchasing from outside the United Kingdom, we cannot be held responsible for any differences to the exchange rate between the time of purchase and the time the payment is completed.

While we try to ensure that all prices on our website are accurate, mistakes do sometimes occur. If we discover an error in the price of products you have ordered, we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as being cancelled. If the order is cancelled, we will refund any money that we have taken from you.

We reserve the right to change our prices.

Payment

Credit card and debit card payments are made through PayPal, which makes automatic checks for suspicious and potentially fraudulent transactions. In such cases, or if we have any reason to suspect a transaction is fraudulent, we will take steps to establish whether the transaction carries an unacceptable level of risk to Rare Memorabilia. We reserve the right to refuse any such order, for any reason.

Availability

All orders are subject to availability of products. If products you order are not available, we will notify you (where possible) and, if we have received the price and the delivery charges of the unavailable products, we will refund them to you as soon as we can.

Delivery

Any time or date stated for delivery is an estimate only. Rare Memorabilia makes every effort to despatch goods on time but does not accept liability for failure to deliver within the stated timeframe.

Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risks of loss, breakage and all damage shall pass to the Customer.

Title in the goods does not pass to the Customer until payment is received in full by Rare Memorabilia.

When ordering goods from Rare Memorabilia for delivery overseas you may be subject to import duties and taxes, which are levied when the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; these charges are outside our control and we cannot predict what they may be. Customs policies vary widely from country to country, so please contact your local customs office for further information.

Right of Cancellation and Returns

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, effective from June 13, 2014, provide customers in the UK with the right to cancel an order for products at any time up to the end of 14 days following the day on which the products were received.

If you wish to cancel your order, please email us with details of your cancellation. If you have already received the products, you must carefully repackage and return them to us at Rare Memorabilia, The Stone Barn, 124 Cromwell Lane, Coventry CV4 8AS, United Kingdom.

You must return the goods to us within 14 days of notifying us you wish to return them. Until you have returned the products to us, you must keep them in your possession and take reasonable care of them. We will credit the price of the cancelled products provided they are received undamaged. All items must be returned 'as sold': in resalable condition, undamaged, in original packaging. If a returned item fails to meet one of these requirements, we cannot accept the item back. If the products are in any way damaged upon return, we will be unable to offer a refund, even if damage occurred during the return transit. We have a right to deduct monies from refunds where goods show signs of unreasonable use leading to diminished value. 

We will refund all monies received, including the outbound delivery cost, within 14 days of receiving the goods back. If you chose to have the goods delivered by a more expensive means than the cheapest standard delivery option offered, we are not obliged to refund the full outbound delivery cost, only the cost of the standard delivery option which you could have chosen.

Description of Products

All products are described in good faith, and while we strive to be accurate at all times, mistakes occasionally happen. All measurements, for example of photographs, are estimates. All products shown are stock images and not necessarily a photo of the item you will receive. Signatures and their placements might vary. Please contact us if you believe the goods you received were inaccurately described.

Rare Memorabilia has a 100 per cent track record for authenticity. All items are accompanied by a Certificate of Authenticity (COA).

 

In the extremely unlikely event that it is suggested that this is not the case, we may ask for the written opinion (on official letterhead) of two competent authorities, acceptable to us: these opinions will be at the purchaser’s cost. We may then gain the opinion of a further expert at our cost. If, on the balance of the opinions received, we consider that doubt exists, we may offer a full refund of the purchase price. If the item was purchased at a charity event then the amount passed onto the charity will be deducted from the purchase price. This will be the customer’s sole course of remedy. In no event will our liability to a purchaser exceed the purchase price actually paid.

 

This guarantee is limited to the original purchaser only and for a period of 12 months from the date of the purchase. The item must be in its original frame and should not have been tampered with in any way without our prior written permission.

These terms and conditions shall be governed by and construed in accordance with English law. If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be cut and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
